Garen Marshall is a partner in McGuireWoods’ Government Investigations and White Collar Litigation Department and leads the firm’s Artificial Intelligence Practice Area. A former Assistant United States Attorney in the Eastern District of New York and Navy special operations veteran, he represents corporations, executives, and boards in government and internal investigations, regulatory enforcement matters, and complex civil litigation, with a practice that extends to AI governance, AI-related enforcement and litigation risk, and corporate compliance issues involving artificial intelligence.

In the Eastern District of New York, Garen served in the National Security and Cybercrime Unit and the Organized Crime and Gangs Unit, prosecuting wire fraud, securities fraud, honest services violations, money laundering, and racketeering. He brings that prosecutorial background to investigations, enforcement matters, and complex disputes involving financial fraud, securities violations, and institutional misconduct across industries including financial services, healthcare, private equity, higher education, professional sports, and emerging technology. Earlier in his career, he served as a secondee to a leading global financial services company and as a federal law clerk.

Garen’s investigations and enforcement background informs his approach to AI-related matters, particularly how regulators and prosecutors evaluate AI-related conduct and the resulting enforcement and litigation exposure. He advises clients on AI governance frameworks, vendor diligence, privilege and confidentiality issues involving AI tools, AI-related disclosures and representations, and AI washing and related enforcement risks. He regularly publishes and speaks on AI governance and AI enforcement developments across DOJ, the SEC, and federal and state regulators.

Before becoming a lawyer, Garen served in the United States Navy as an explosive ordnance disposal technician during Operation Iraqi Freedom, receiving the Bronze Star, Army Commendation Medal, and twelve other military service medals. He has led veterans advocacy initiatives, including at NYU School of Law, where his efforts helped establish one of the nation’s most generous funding programs for eligible veterans. He continues to support veterans causes, including through his service on the board of Veterans Bridge Home and as McGuireWoods’ veterans pro bono coordinator.

  • Conducted an internal investigation on behalf of a multi-national technology company related to insider trading by a corporate executive and obtained nearly $800,000 in restitution for the client.
  • Conducted a cross-border internal investigation on behalf of a large financial institution related to manipulation of the London Interbank Offered Rate (LIBOR).
  • Represented the former COO of a registered investment advisor in connection with an SEC investigation related to the sale of a large, collateralized debt obligation.
  • Represented a multinational investment bank in civil litigation arising out of the purchase of nearly $200 billion of residential mortgage-backed securities.
  • Conducted an internal investigation related to insider trading on behalf of a mid-size software company following DOJ and SEC inquiries.
  • Conducted an internal investigation on behalf of a cryptocurrency exchange in response to a CFTC inquiry.
  • Advised numerous corporate clients regarding FINRA inquiries related to mergers and acquisitions.
  • Served as a secondee to Morgan Stanley’s Legal & Compliance Division.
  • Investigated and prosecuted criminal matters involving wire and securities fraud, honest services fraud, tax fraud, money laundering, asset forfeiture, racketeering and organized crime, cybercrime and violent crime.
